Introducing Homebuyer+
We have introduced a reimbursement scheme to minimise losses to our clients in case their purchase falls through. English law does not provide for reimbursement or damages to a buyer in the event of being “gazumped” by the seller. There are also no remedies if there are defects in the title or adverse search results resulting in the buyer not proceeding with the purchase. A buyer can only claim damages from the seller if there is a breach of contract. The contract is not entered into until after the searches have been completed which could be some weeks after the price was agreed with the estate agent. Usually each party pays their own out of pocket expenses which can be frustrating for a buyer if the purchase does not complete. Maria Lati, a partner in the firm’s residential conveyancing department said “In the current economic climate Grant Saw wanted to soften the blow to our clients buying a residential property should the purchase not complete for reasons beyond their control. The costs can amount to several hundred or even thousands of pounds when considering mortgage application fees, survey/valuation fees, searches and legal costs. Our scheme is known as Homebuyers Plus which is like a warranty or guarantee that will give you that peace of mind by us reimbursing certain out of pocket expenses should your purchase not complete through no fault of your own” Grant Saw’s Homebuyer Plus scheme applies to all new property instructions received from 14th May 2012 and will refund up to £500 for non-refundable mortgage arrangement fees, £750 for a survey fee, £600 in solicitors disbursements and £250 solicitors legal fees. Maria continued “We can’t remove the uncertainty from a property purchase but we can certainly improve our clients’ experience of the legal process if their dream home or investment purchase fails before exchange of contracts”.
