Grant Saw’s employment law department is able to provide expertise,
gained from many years’ experience of providing specialist employment
law advice, in dealing with all types of contentious and non-contentious
employment matters on behalf of both employers and employees.
- Drafting or review of
- Contracts of employment, directors’ service
agreements, consultancy agreements, secondment agreements and staff
handbooks.
- Employment procedures and policies on discipline, dismissal, grievances,
equal opportunities, maternity leave and other family-friendly employment
rights, confidentiality and computer use.
- Advice on
- Redundancy, management/staff restructuring, disciplinary and capability
issues, working time, variation of terms and conditions of employment,
data protection, collective information and consultation requirements,
various statutory employment protection rights and the validity and
enforcement of post-termination restrictive covenants.
- Employment and pensions aspects of the acquisition and disposal
of businesses and the outsourcing of work, in particular the applicability
and implications of the Transfer of Undertakings (Protection of Employment)
Regulations (TUPE), and drafting and negotiating relevant warranties
and indemnities.
- Associated immigration and nationality matters and, in particular,
preparing work permit and other business-related immigration applications.
- Dispute resolution
- Negotiating appropriate terms of severance, thereby avoiding litigation,
and advising on the strategy and tax aspects of such severance.
- Drafting, and advising as to the terms and
effect of, compromise agreements.
- Where litigation becomes necessary, providing representation in employment
tribunal cases concerning all types of claims, including unfair dismissal,
wrongful dismissal, unlawful discrimination (for
example, on the grounds of sex, race or disability), equal pay and
whistle-blowing, and in court cases concerning such matters as enforcement
of post-termination restrictive covenants and breach of contract.
