Why (or when) someone would need this service?

A developer would approach us to assist them in their land acquisition with a view to building residential or commercial units on the site.

How does the process work/what are the steps?

The process is the same as for the acquisition of freehold property except we may undertake some additional searches relevant to developers, for example to ascertain the whereabouts of electricity or gas installations on the site.

How long does it take?

A typical transaction may take six to eight weeks. Although if the purchase is conditional on obtaining planning permission or subject to the grant of an option to buy the land then it may take considerably longer than this.

Is it expensive ? How do the costs work?

We will charge on a sliding scale according to the value of the development and the complexity of the Heads of Terms agreed between the parties.

What are the things people should consider before calling?

It would be helpful to have a clear idea of the land to be purchased, the conditions attaching to the purchase (for example whether the seller is to obtain any overage payment – a payment if the land is developed more densely than anticipated) and what will constitute an “acceptable” planning permission if the deal is conditional upon planning permission being obtained.

If the purchaser is relying on existing planning permission always make sure that rights to use the design drawings are assigned in the purchase contract if necessary with the architects consent.
